Judgment text excerpt

The Supreme Court held that under Section 14(2) of the Rent Control Act, a tenant cannot be evicted for default in rent payment if they comply with an order under Section 15. The Court clarified that the benefit of immunity from eviction under Section 14(2) is contingent upon an order for possession not being passed due to compliance with Section 15. In this case, since the landlord withdrew the earlier ejectment application, it was determined that the tenant did not obtain the benefit of Section 14(2), leading to the restoration of the Rent Controller's order for eviction.
