Judgment text excerpt

The Supreme Court held that under Section 82A of the Indian Railways Act, 1890, liability for compensation arises only when there is an accident to the train or a part of it, which must have a nexus with the injury sustained by the passenger. The Court clarified that mishaps occurring while getting on or off a train, or due to the passenger's own actions, do not attract liability under this section. In this case, since there was no accident to the train, the claim for compensation was dismissed, affirming the High Court's ruling.
