The Supreme Court ruled that the amendments made to the Punjab Government National Emergency (Concessions) Rules, 1965, with retrospective effect, infringe upon the vested rights of government servants who had joined military service during the emergency. The Court held that such amendments cannot deprive individuals of benefits accrued from their military service, as guaranteed under Article 309 of the Constitution. Consequently, the Court allowed the appeals and quashed the retrospective amendments that limited the recognition of military service for seniority purposes.
