The Supreme Court held that Section 158(1)(b) of the Madhya Pradesh Land Revenue Code, 1959, results in the complete extinction of inam rights and the conferral of bhumiswami rights, thereby making the inam lands the separate property of the bhumiswami. The Court found that the rule of impartibility and lineal primogeniture no longer applied post-extinction of inam rights. The High Court's reversal of the Additional District Judge's decree was set aside, affirming the plaintiffs' right to partition and separate possession of their share in the joint family property, excluding the inam lands.
