The Supreme Court interpreted Section 4(9) of the Urban Land (Ceiling and Regulation) Act, 1976, clarifying that the ceiling area computation must consider three categories of urban land: entirely open land, entirely built land, and land partially built with appurtenant open land. The Court held that the District Judge's exclusion of portions of land for beneficial enjoyment was incorrect, thereby disapproving the High Court's ruling. The appeals were allowed, and the cases were remanded to the competent authority for fresh computations.
