The Supreme Court held that under Section 15 of the Delhi Land Reforms Act, 1954, a tenant who has acquired Bhumidhar status is entitled to compensation for land acquired under the Land Acquisition Act, 1894. The Court clarified that the landowners could not claim Bhumidhar rights over the mortgaged land since it was in the possession of the tenant, Sewa Ram, at the time of the Act's commencement. The Court dismissed the landowners' appeal, affirming that Sewa Ram was entitled to the entire compensation as a Bhumidhar.
