The Supreme Court held that under Section 4(1) of the Maharashtra Agricultural Lands (Ceiling on Holdings) Act, 1961, all land held by each member of a family unit, whether jointly or separately, is deemed to be held by the family unit for computing the ceiling area. The Court clarified that the nature of the property, whether separate or stridhan, is irrelevant for this purpose. The appeal was allowed, affirming that the land owned by the wife must be included in the family unit's total holding for ceiling determination.
