The Supreme Court held that the U.P. Intermediate Education Act, 1921, Section 16-F(4) does not have retrospective effect, thus the Director of Education retained the power to appoint a Principal of a minority institution despite the amendment of 1975. The Court clarified that existing rights should not be impaired by new statutes unless explicitly stated. The appointment of the respondent as Principal was upheld as the selection process had commenced prior to the amendment, and the earlier disapproval by the Deputy Director did not disqualify the respondent from consideration.
