Judgment text excerpt

The Supreme Court addressed the issue of whether a cinematograph license held by a partner in his individual capacity constitutes an interest attached to the premises owned by a partnership. The Court held that the partnership does not acquire any interest in the license merely because the premises and the cinematograph are owned by the partnership. It was determined that the license is personal to the individual partner and does not automatically transfer to the partnership under Section 6F of the Jammu and Kashmir (Cinematograph) Act, 1989. The appeal was dismissed, affirming the lower court's ruling.
