The Supreme Court held that the termination of the petitioner's employment after reaching the age of superannuation does not constitute 'retrenchment' under Section 2(00) of the Industrial Disputes Act. The Court found that the petitioner had willingly accepted a fresh contract of employment for twelve months after retirement, and thus his case did not attract the provisions of Section 25F of the Act. The petition for Special Leave to appeal was dismissed, affirming the Labour Court's decision that the petitioner was not entitled to reinstatement.
