Judgment text excerpt

The Supreme Court held that the failure to supply translations of documents relied upon in the language known to the detenu, as mandated by Article 22(5) of the Constitution, constitutes a violation of constitutional rights. The Court found that the detaining authority's delay in providing these translations without communicating the reasons for such delay invalidated the detention order. Consequently, the Court upheld the revocation of the detention order under Section 8(f) of the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act, 1947 (COFEPOSA).
