Judgment text excerpt

The Supreme Court held that under Section 17 of the West Bengal (Transfer of Territories) Act, 1956, proceedings pending in the Patna High Court must be certified for transfer to the Calcutta High Court; otherwise, they remain under the jurisdiction of the Patna High Court. The Court ruled that the State of West Bengal should be deemed substituted for the State of Bihar in matters concerning compensation for acquired lands, even without formal substitution. The executing court's dismissal of the execution petition was upheld, affirming that the decrees against Bihar are binding on West Bengal as per Section 47 of the Act.
