Judgment text excerpt

The Supreme Court held that in cases of culpable homicide, the appropriate sentence under Section 304 IPC should be imposed instead of Section 302 IPC when evidence indicates a sudden fight in the heat of passion. The Court found that the prosecution failed to prove the probability of culpability beyond reasonable doubt, thereby granting the benefit of doubt to the accused. Consequently, the appeal was allowed in part, acquitting Ram Karan and modifying the sentences of his sons under Sections 304(1)/34 IPC instead of Sections 302/34 IPC.
