The Supreme Court held that under Section 82(1)(a) and (b) of the Jaipur State Grants Land Tenures Act, 1947, the determination of rent rates must be validly settled for a jagir to be considered settled. The Court quashed the previous settlement order from 1953, establishing that the jagir was unsettled at the time of resumption, thus entitling the jagirdar to compensation based on the unsettled status. The Court emphasized that retrospective realization of rent does not equate to a settled status, and the right to compensation vests at the time of resumption, unaffected by subsequent amendments unless explicitly stated.
