DR. ASIM KUMAR BOSE vs UNION OF INDIA & OTHERS

The Supreme Court held that the teaching experience gained by the appellant, Dr. Asim Kumar Bose, as a Radiologist-cum-Associate Professor at Irwin Hospital should be considered for eligibility for promotion to Professor or Associate Professor under Rule 8(2A) of the Central Health Service Rules, 1963. The Court found that the Government of India failed to distinguish between teaching and non-teaching hospitals, thus misapplying the eligibility criteria. The appeal was allowed, overturning the High Court's decision that denied the appellant's claim based on insufficient teaching experience.
