The Supreme Court held that under Section 14(1)(d) of the Delhi Rent Control Act, 1958, a landlord can recover possession if neither the tenant nor any family member has resided in the premises for six months prior to the application. The Court clarified that the term 'family' should be interpreted broadly to include near relations, and the migration of the main tenant does not affect the status of family members residing in the premises. The appeal was allowed, reversing the High Court's dismissal of the family members' eviction appeal.
