The Supreme Court interpreted Section 13(2)(ii)(a) of the East Punjab Urban Land Restriction Act, 1949, holding that a tenant who sub-lets a portion of the premises with the written consent of the landlord does not become liable for eviction upon the determination of tenancy. The Court found no evidence supporting the Rent Controller's claim that the tenant sub-let the premises unlawfully after April 1974. Consequently, the tenant's sub-letting was deemed lawful, and the landlady's eviction petition was dismissed.
