Judgment text excerpt

The Supreme Court addressed the convictions under Section 302 read with Section 149 IPC, where out of twelve accused, eight were convicted, with two sentenced to death and others to life imprisonment. The Court found that the prosecution's reliance on dying declarations and eyewitness accounts was insufficient to uphold the death sentences due to inconsistencies and the possibility of mistaken identity. Consequently, the death sentences were commuted to life imprisonment, while the convictions of the remaining appellants were affirmed.
