The Supreme Court held that under Section 3(4)(b) of the Madras Cultivating Tenants Protection Act, 1955, a Revenue Divisional Officer cannot issue a conditional eviction order while granting time for a tenant to deposit rent arrears. The Court found that such orders contravene the Act's provisions, as eviction can only occur if the tenant fails to deposit the specified amount after the granted time. Consequently, the Court allowed the appeals and declared the eviction orders invalid due to lack of jurisdiction.
