Judgment text excerpt

The Supreme Court interpreted Section 21(1)(h) and Section 157(1) of the U.P. Zamindari Abolition and Land Reforms Act, 1950, clarifying that the benefit of being classified as a 'Sirdar' is contingent upon the landholder being a 'disabled person' on the date of vesting. The Court held that since both Smt. Ram Kali and her successor Dan Sahai were 'disabled persons' on the relevant dates, the respondents could not be deemed Sirdars and remained Asamis. The appeals were allowed, reversing the High Court's decision.
