The Supreme Court ruled that the provisions of Section 6 of the Hindu Succession Act, 1956, override the customary rule of primogeniture, thereby allowing female heirs to inherit property. The Court held that the Nagaruntari estate, previously governed by the rule of primogeniture, ceased to be so after the enforcement of the Hindu Succession Act. Consequently, the legal representatives of both the plaintiff and defendant were entitled to succeed to the estate, affirming the applicability of Section 12A of the Chota Nagpur Encumbered Estates Act regarding the validity of the khorposh deed.
