The Supreme Court held that under Section 11(4)(i) of the Kerala Buildings (Lease and Rent Control) Act, 1965, a tenant can be evicted for sub-letting unless such sub-letting is permitted by the lease or with the landlord's consent. The Court clarified that Section 108(j) of the Transfer of Property Act does not provide a defense against eviction if the lease does not confer the right to sublet. The appeal was dismissed, affirming the eviction order as the tenant had sublet without the landlord's permission.
