Judgment text excerpt

The Supreme Court addressed the issue of whether Railway Protection Force (RPF) officers qualify as 'Police Officers' under Section 25 of the Indian Evidence Act, 1872. The Court held that RPF officers do have the authority to investigate offences under the Railway Property (Unlawful Possession) Act, 1966, thus falling within the definition of 'Police Officers'. The Court also ruled that the appellant's right to obtain copies of documents was violated, as the Magistrate's refusal was based on an incorrect interpretation of the cognizability of the offence under Section 251A of the Criminal Procedure Code, 1898.
