Judgment text excerpt

The Supreme Court held that under Section 4 of the Bombay Pargana and Kulkarni Watans (Abolition) Act, 1950, the respondent was entitled to the regrant of watan lands as the appellants were found to be strangers to the watan and could not seek an order under this section. The Court dismissed the appeal from the High Court's order restoring the regrant in favor of the respondent, affirming that the findings of the authorities under the 1950 Act were conclusive. The Court clarified that the rejection of a prior application under Section 10 of the Bombay Hereditary Offices Act, 1874, had no bearing on the regrant process under the 1950 Act.
