The Supreme Court held that the jurisdiction of the Civil Court is not barred in disputes arising from disciplinary proceedings against employees of a Co-operative Cane Growers’ Society, as per Rule 115 of the Co-operative Societies Rules, 1936, and Section 43 of the Co-operative Societies Act, 1912. The Court found that the respondent, a Supervisor, did not qualify as an 'officer' of the society under the relevant definitions, thus allowing the Civil Court to entertain the suit. The appeal was dismissed, affirming the High Court's ruling that there was no compulsory arbitration provision for such disputes under the applicable laws.
