The Supreme Court held that Sections 7 and 16 of the U.P. Motor Vehicles (Special Provisions) Act, 1976 validly apply to both sections 68C and 68D of the Motor Vehicles Act, 1939, clarifying that the specification of the number of services is not an essential requirement for the validity of a draft or approved scheme. The Court overruled the decision in Shashi Kant Rai & ors. v. Regional Transport Authority, Varanasi Region, AIR 1978 All. 68, establishing that failure to specify the number of services does not invalidate the scheme. The impugned scheme was upheld as operative despite not mentioning the maximum or minimum number of buses or trips, as it provided the necessary particulars in the U.P. Gazette notification.
