The Supreme Court held that under Section 17(2) of the Prevention of Food Adulteration Act, 1954, a company can nominate a responsible person for prosecution, and other officers can only be prosecuted if there is evidence of their consent or neglect. The Court found that the allegations in the complaint established a prima facie case against the respondents for an offence under Section 7(1) read with Section 16(1)(a) of the Act. The dismissal of the complaint against the sales managers was overturned, allowing the appeal by special leave.
