The Supreme Court upheld the High Court's decision to strike down Rule 5 of the Survey of India (Recruitment from Corps of Engineer Officers) Rules 1950, which favored military officers over civilian officers in seniority, as violative of Articles 14 and 16 of the Constitution. The Court found that the classification between military and civilian officers lacked a reasonable nexus to the objectives of the recruitment rules, as both groups performed similar functions within the Survey of India. The Court affirmed that equal treatment must be afforded to all officers post-recruitment, regardless of their initial entry source.
