Judgment text excerpt

The Supreme Court held that the election of the appellant to the Lok Sabha was void due to corrupt practices under Section 123(3A) of the Representation of the People Act, 1951. The Court found that the appellant's speech, although not fully reported, could be relied upon as the appellant admitted its content was largely accurate. The Court clarified that Section 125 is not relevant for interpreting Section 123(3A) and upheld that Section 123(3A) does not violate Article 19(1)(a) of the Constitution.
