Judgment text excerpt
The Supreme Court upheld the High Court's decision to set aside the appellant's election, determining that he did not belong to a Scheduled Tribe as defined under the Representation of People Act, 1951 and the Scheduled Tribes Order, 1950. The Court clarified that the omission of the term 'including' in the 1976 amendment indicated that the 'Mana' community does not necessarily have to have affinity with the 'Gond' tribe to be recognized as a Scheduled Tribe. The Court concluded that the 'Kshatriya Bidwaik Mana' community, to which the appellant belonged, could not be classified as a Scheduled Tribe under the relevant provisions.
