The Supreme Court held that under Section 3(1)(a) of the U.P. (Temporary) Control of Rent and Eviction Act, 1947, the appellant was not in 'arrears of rent for more than three months' as the pre-agreement arrears had transformed into a consolidated debt due to an agreement made on June 13, 1960. The Court ruled that the arrears of three instalments under the agreement could not be combined with the rent due for the three months preceding the notice for eviction. Consequently, the appeal was allowed, and the eviction order was set aside.
