Judgment text excerpt

The Supreme Court addressed the validity of the Central Government's order under Section 45(10) of the Banking Regulation Act, 1949, which allowed the Travancore Bank to continue Chitties previously managed by the Orient Bank despite a moratorium. The Court held that the order did not suffer from excessive delegation of legislative power and affirmed that the amalgamation scheme effectively transferred all rights and liabilities of the Orient Bank to the Travancore Bank. Consequently, the appeal was allowed, and the dismissal of the respondent's suit was overturned.
