The Supreme Court held that Section 6(1) of the Prevention of Corruption Act, 1947, applies only if the offender was a public servant at the time of the offence. Since the appellant had ceased to be a public servant when the special judge took cognizance, no sanction under Section 6 was required. The Court dismissed the appeal, affirming that a deeming provision should not lead to absurd outcomes and should be confined to its intended purpose.
