The Supreme Court held that the sample of chocolate ice cream was not adulterated under the Prevention of Food Adulteration Act, as the prohibition in Rule 61's proviso does not apply to ice cream, kulfi, and chocolate ice cream, which may contain permitted stabilizers and emulsifiers up to 0.5% by weight. The Court clarified that brominated vegetable oils could be included in chocolate ice cream without constituting adulteration. The prosecution failed to prove that the sample contained any prohibited ingredient, leading to the acquittal of the accused.
