The Supreme Court held that under the Madhya Pradesh Accommodation Control Act, 1961, the court has the jurisdiction to extend the time for deposit of monthly rent falling due after the filing of a suit for eviction. It clarified that a tenant must pay or deposit arrears within one month of receiving the summons and continue monthly payments by the 15th to claim protection under Section 12(3). The court emphasized that failure to pay on time does not automatically entitle the landlord to eviction, as the court has discretion under Section 13(6) to condone delays in payment.
