The Supreme Court held that the petitioner was senior to the respondent in the Delhi Higher Judicial Service, as per Rule 6(3) of the Delhi Higher Judicial Service Rules, 1970, which mandates that seniority is determined by length of service in the respective cadres at the time of initial recruitment. The Court found the order of the Lt. Governor, which placed the respondent senior to the petitioner, to be erroneous. Consequently, the petition was allowed, reaffirming the petitioner's seniority.
