The Supreme Court upheld the decisions of the High Court and Revenue Tribunal, affirming that the lands in question did not vest in the Government under Section 6 of the Bombay Taluqdari Tenure Abolition Act, 1949 and Section 7 of the Bombay Personal Inams Abolition Act, 1952. The Court clarified that the vesting provisions apply only to properties that can be put to public use, leaving private properties of taluqdars untouched. It was determined that the grass lands, although uncultivated, were not 'waste lands' as defined by the statutes, since they were capable of natural growth and thus did not meet the criteria for vesting in the Government.
