Judgment text excerpt

The Supreme Court held that there cannot be discrimination under Article 14 of the Constitution merely due to different treatment of distinct categories of employees, such as Commercial Clerks and ASMs/SMs. The Court found that the Andhra Pradesh High Court's decision was incorrect as it did not account for the fact that ASMs/SMs would not have received increments had they remained as Commercial Clerks. The Court upheld the Andhra Pradesh decision but set aside the law laid down by it, clarifying that only those employees who were part of the appeals would draw emoluments as per the new ruling.
