Judgment text excerpt

The Supreme Court examined the scope of Article 30(1) of the Constitution concerning the rights of linguistic and religious minorities to manage educational institutions. The Court held that while regulatory restrictions can be imposed, they must not interfere with the right to appoint and dismiss staff, and that providing a right of appeal against dismissal is permissible under certain conditions. The dismissal of the Appellant was found to be in violation of principles of natural justice, leading to the conclusion that the orders of dismissal and suspension were illegal and void, thereby reinstating the Appellant as Principal.
