The Supreme Court held that the jurisdiction of the Special Judge under Section 8(1) of the Criminal Law Amendment Act, 1952 is not limited by a pardon granted by a Magistrate under Section 337(1) of the Cr.P.C., 1898. The Court found that the provisions do not violate Article 14 of the Constitution, as the Special Judge is still required to apply established tests for the appreciation of accomplice evidence. The appeal was dismissed, affirming the High Court's decision to not quash the proceedings against the appellant.
