The Supreme Court held that under Section 120A and 120B of the Penal Code, the essence of criminal conspiracy lies in the agreement among conspirators to achieve a common illegal objective, and it is not necessary for all conspirators to know every detail of the conspiracy. The Court dismissed the appellant's appeal, affirming that the lack of sanction under Section 196A(2) of the Criminal Procedure Code does not invalidate the trial under Section 120B IPC, as long as the accused is a party to the conspiracy. The Court reiterated that the charges against the accused do not need to include the ultimate offence of the conspiracy for liability to arise under Section 120B IPC.
