The Supreme Court interpreted Section 7 of the Punjab Customs (Power to Contest) Act, 1920, as amended by the Punjab Customs (Power to Contest) Amendment Act, 1973, which prohibits contesting alienations of immovable property on the grounds of custom. The Court held that a declaratory decree obtained by reversioners restores the alienated property to the estate of the alienor, allowing heirs to claim possession post-death. The decree obtained by appellants 1 to 12 was upheld, entitling the respondent, as an adopted son, to possession of the gifted property, as it was freed from encumbrance at the time of Mula's death.
