Judgment text excerpt
The Supreme Court held that in appeals against acquittal under Section 378 of the Code of Criminal Procedure, the High Court must consider the reasons provided by the trial court for acquittal. The Court found that the High Court failed to do so and thus interfered improperly with the acquittal of the appellants. Additionally, the Court clarified that confessions made under duress or inducement, as per Section 24 of the Evidence Act, must be evaluated from the perspective of the accused's mindset at the time of confession. The appeals were allowed, and the convictions by the High Court were set aside.
