Judgment text excerpt

The Supreme Court held that in a suit for rendition of accounts under the Partnership Act, the trial Court correctly viewed the accounts of two shops owned by the same plaintiff as a composite entity, allowing for set off between them. The High Court's remand order did not restrict the trial Court from considering the city accounts in totality, thus the trial Court's decree was restored. The Court emphasized that the dealings were between the same parties and should not be artificially dissected into separate juristic entities.
