Judgment text excerpt

The Supreme Court held that Section 138 of the Indian Railways Act does not require the complainant to be specifically authorized by the Railways for a complaint to be maintainable. The Court clarified that an application can be filed on behalf of the railway administration by a high officer, thus overturning the Patna High Court's decision which quashed the eviction order on the grounds of lack of authorization. The appeal was allowed, and the eviction order was upheld.
