The Supreme Court held that an appeal under Clause 10 of the Letters Patent is considered incomplete if not accompanied by the requisite three copies of the paper book as mandated by Rule 3 of Chapter 2-e of the High Court Rules. The Court clarified that such an appeal shall not be deemed filed until it is complete in all respects. The Division Bench's dismissal of the appeal as barred by limitation was upheld, as the appellant failed to establish sufficient cause for condonation of delay under Section 5 of the Limitation Act, 1963.
