The Supreme Court held that extra departmental agents, as defined under Rule 2(b) of the Posts and Telegraphs Extra-Departmental Agents (Conduct and Service) Rules, 1964, hold a 'civil post' under Article 311(2) of the Constitution of India. Their dismissal or removal without compliance with Article 311(2) is invalid. The Court affirmed the High Courts' decisions that the respondents' terminations were unlawful due to the lack of due process as mandated by the Constitution.
