The Supreme Court held that Section 9(1) of the Life Insurance Corporation Act, 1956 does not create a legal fiction regarding debts owed to the Corporation. The Court affirmed that debts taken by agriculturists from insurance companies prior to the Corporation's formation are subject to scaling down under Section 4(e) of the Madras Agriculturists Relief Act, 1938. The appeals were dismissed, confirming that the liabilities associated with the debts were transferred to the Corporation and must be honored in accordance with the 1938 Act.
