The Supreme Court upheld the Gujarat High Court's decision that the appointments of the Writ Petitioners as clerks were regular and did not require regularization under the Gujarat Non-Secretariat Clerks, Clerk Typists and Typists (Direct Recruitment Procedure) Rules, 1970. The Court found that the Centralized Recruitment Scheme was not applicable at the time of their appointment and that the State Government's resolution regarding seniority was invalid. Consequently, the Court directed the State Government to treat the entire service of the Writ Petitioners as regular and to fix their seniority based on their actual dates of joining.
