Judgment text excerpt
The Supreme Court held that under Section 18(1) of the Industrial Disputes Act, 1947, a settlement reached by a recognized trade union can be binding on all workers, even if a minority of workers do not belong to that union. The Court found that the settlement was fair and just, and thus substituted it for the prior award of the Industrial Tribunal. The appeal was dismissed, affirming the validity of the settlement despite the claims of the second respondent union regarding its membership.
